2. APPLICATION OF THE GENERAL CONDITIONS OF SALE

These General Conditions of Sale (hereinafter “T&Cs”) define the terms of sale between Love So Cakes and the Customer within the framework of a distance selling system on the Internet and mobile, within the framework of its activity.

These General Terms and Conditions are brought to the attention of each Customer to enable them to place an order and make their purchases.

The fact of the Customer completing an order on the Site (filling the basket) and confirming the order (validating the basket) constitutes full acceptance of these General Terms and Conditions, which will only be applicable to the following contract.

Love So Cakes reserves the right to modify these General Terms and Conditions in whole or in part at any time.

 

3. PRODUCTS AND ITEMS

The products offered to the Customer are those which appear in the catalog published on the Site within the limits of available stocks and subject to the proper functioning of the Site.

Each product is presented accompanied by a photograph and a description established by Love So Cakes. The descriptions are intended to present to the Customer the essential characteristics of the products before taking the final order and cannot in any way engage the responsibility of Love So Cakes. Product visuals are provided for information purposes only and are not contractual.

All custom cake design cake creations are made only to order after validation of the quote.

Love So Cakes only creates original creations, and therefore does not make identical reproductions of existing cakes.

Love So Cakes guarantees the Customer that the products are manufactured and packaged according to strict quality rules and preserved in accordance with the standards in force in France. 

However, Love So Cakes cannot extend its guarantee on its products if the Customer has not respected optimal storage and transport conditions, or if the Customer has consumed products beyond the shelf life date for fresh pastries.

 

4. PRICE

The prices of the goods sold are those in effect on the day the order is taken.

However, prices cannot be modified once the order has been confirmed.

The prices indicated are in Euros including tax.

 

5. ORDER

For cake design and wedding cake orders, a quote is provided on request.

The order will be validated after payment of a 50% deposit.

In the event of cancellation, ​the deposit is not refunded. Under conditions, a credit may be offered, which can be used to postpone the initial service to a later date (excluding vacation periods, and depending on availability). An amendment to the quote will be established for this new date, which will take into account seasonality and, if applicable, the increase in the cost of raw materials on the chosen date.

The total order must be paid in full on the day of collection or delivery of the product(s).

The Customer undertakes to complete the order form accurately and to fill in the various existing sections (full name, billing address, payment method, etc.). He will receive, after payment, an email confirming the details and terms of his order. The order only becomes valid if all the information requested from the Customer is provided.

By clicking on the “Pay my order” site icon, the customer acknowledges having full legal capacity to commit to the General Conditions of Sale, which are the only ones applicable to the following contract. The site is accessible by the customer 24 hours a day, 7 days a week, except during the annual holiday period and in the event of maintenance operations.

Before paying for the order, the Customer declares having read and accepted these General Terms and Conditions. Validation of the order therefore constitutes unreserved acceptance of these General Terms and Conditions.

For any modification of an online order, the Customer must contact Love So Cakes no later than 96 hours before the order collection date. By email lovesocakes@gmail.com. For any modification to a cake design and wedding cake order, the customer must contact Love So Cakes no later than 10 working days before the order collection date. No refund of deposit can take place.

Love So Cakes reserves the right to refuse an order in the event of the customer's failure to fulfill one of its obligations and more generally, to refuse any order that is offensive, abnormal or incomplete for any reason whatsoever. The order is only final after confirmation by Love So Cakes. L'Atelier Love So Cakes will confirm to the customer the acceptance of their order by email or, where applicable, its refusal within 48 working hours of entering their order on the Internet.

 

6. MEANS OF PAYMENT

Payment for products online, or payment of deposit, is made only by credit card CB, VISA, MASTERCARD, online from the Site. Validation of payment by credit card is immediate.

To be registered, the order must be paid in full. In addition, Love So Cakes authorizes itself to suspend any order or delivery in the event of refusal of payment authorization from financial organizations.

 

7. RIGHT OF WITHDRAWALNOT

In accordance with current legislation, the right of withdrawal does not apply to contracts relating to the supply of perishable, agri-food products, such as products sold by the Site. Also, the Client cannot rely on this.

Any modification or cancellation of an online order by the Customer may be taken into account 96 hours before collection of the order, and may give rise to reimbursement in the event of cancellation. Any modification or cancellation of a custom cake design or wedding cake order by the Customer may be taken into account up to 7 working days before collection or delivery of the order but will not give rise to any refund of deposit. .

This possibility is appreciated on a case by case basis by Love So Cakes.

 

8. AVAILABILITY OF PRODUCTS

The products sold on the Site are offered while stocks last. A product that has become unavailable will, as soon as possible, be removed from the product catalog or indicated as unavailable for a limited period.

However, if it is impossible to provide the requested products, Love So Cakes will contact the Customer by e-mail or by telephone as soon as possible in order to agree with them to postpone delivery while waiting for the restocking of this product, when this is possible, or to replace the product with another equivalent in quality and price.

L'ove So Cakes products are handcrafted and are available in limited quantities.

 

9. DELIVERY TERMS

WITHDRAWAL

The Customer undertakes to collect their order from Love So Cakes at the address indicated if applicable, on the day planned when ordering and during the time slot they have chosen. As the products are perishable, Love So Cakes will not be able to keep an order that has been forgotten by the Customer. Any forgotten order cannot be refunded under any circumstances.

In the event of non-compliance with the chosen collection time slot, Love So Cakes does not guarantee the availability of your order, and will not give rise to any refund or complaint.

During direct collection by the Customer, the transport risk is borne in full by the Customer. Love So Cakes' responsibility stops at the laboratory doors.

 

10. INTELLECTUAL PROPERTY AND PROHIBITION

The structure, layout, graphic charter, texts, database, images, photos, sounds, videos and any other element making up the Site are and remain the intellectual and exclusive property of Love So Cakes .

The reproduction, rebroadcast or use for any reason whatsoever, even partially, of elements of the Site are subject to the express prior authorization of Love So Cakes, owner of all intellectual property rights. The user who has an Internet site and who wishes to place a simple link on his site directly to the site must first request authorization from Love So Cakes.

The Customer must under no circumstances resell products which are intended for his personal use or that of the person receiving his order. Any total or partial reproduction, modification or use of the products or their images for any reason whatsoever is strictly prohibited.

 

11. INDEPENDENCE OF CLAUSES

If any of these general conditions should be declared inapplicable or is invalidated for any reason, this invalidity will not affect the application or validity of the other provisions of the general conditions, the one invalidated or deemed inapplicable being then replaced by the provision as close as possible.

 

12. FORCE MAJEURE

Neither Love So Cakes nor the Client can be held responsible in the event of non-performance, non-execution or delay in the execution of one of its obligations described in these General Terms and Conditions which would have originated in a case of force. major, as defined by the courts.

 

13. APPLICABLE LAW

These general conditions are governed exclusively by French law. The language of this contract is French. In the event of translation, only the French version is authentic.

Any dispute will fall under the jurisdiction of the Val d'Oise Commercial Court once amicable means have been exhausted.
